These terms apply to your use of the Fanfare platform as a buyer. Please read them before placing an order.

1. About Us

Fanfare is operated by Fanfare 51 Ltd, a company registered in England and Wales. Our registered office is at 66 Paul Street, London, EC2A. You can contact us at hello@wearefanfare.uk.

References to 'Fanfare', 'we', 'us', or 'our' in these terms refer to Fanfare 51 Ltd. References to 'you' or 'buyer' refer to any person who purchases products through the Fanfare platform.

2. The Platform

Fanfare is a marketplace that connects independent artists and labels with buyers. When you purchase a product on Fanfare, your contract is with the seller, not with Fanfare. Fanfare is not a party to that contract and is not responsible for the products sold by sellers.

Fanfare facilitates the transaction and provides the payment infrastructure, but the seller is the merchant of record and is responsible for fulfilling your order, the quality of the product, and handling any post-sale queries.

3. Eligibility

To create a buyer account or place an order on Fanfare you must be at least 18 years of age. By creating an account or placing an order you confirm that you meet this requirement.

4. Buyer Accounts

You may browse Fanfare without creating an account. An account allows you to save delivery addresses and view your order history.

You are responsible for keeping your login credentials secure. Please notify us at hello@wearefanfare.uk if you suspect any unauthorised access to your account.

5. Placing an Order

When you place an order on Fanfare, you are making an offer to purchase from the seller. Your order is confirmed when you receive an order confirmation email. That confirmation constitutes acceptance of your offer and forms a binding contract between you and the seller.

Prices are displayed inclusive of any applicable VAT. Delivery charges, where applicable, are displayed at checkout before you confirm your order.

All payments are processed by Stripe. By placing an order you agree to Stripe's terms of service, available at stripe.com.

6. Delivery Orders

Where you purchase a product for delivery, the seller is responsible for dispatching your order. Delivery timescales are set by the seller and displayed on the product listing.

Fanfare is not responsible for delays or failures in delivery caused by the seller or by third-party couriers.

If your order does not arrive within the stated timeframe, please contact the seller in the first instance. If you are unable to resolve the issue with the seller, you may contact us at hello@wearefanfare.uk and we will do our best to assist.

7. Collect-at-Gig Orders

Some products are available for collection at a live gig rather than delivery. When you place a collect-at-gig order:

If you do not collect your order at the specified gig, you are entitled to either a full refund or a transfer of your order to another eligible gig. Collect-at-gig orders cannot be converted to delivery orders under any circumstances.

8. Your Right to Cancel

Under the Consumer Contracts Regulations 2013, you have the right to cancel most orders within 14 days of receiving your goods without giving a reason. To exercise this right, please contact the seller directly.

The right to cancel does not apply to:

Where you have a right to cancel, the seller is responsible for processing your refund within 14 days of receiving the returned goods.

9. Refunds

If a gig is cancelled by the seller or organiser, you are entitled to a full refund of any amounts paid for orders associated with that gig, or the option to transfer your order to another eligible gig.

Refunds are processed via Stripe and typically appear in your account within 5 to 10 business days, depending on your bank.

For any other refund requests, please contact the seller directly. Your statutory rights are not affected by these terms.

10. Fanfare's Liability

Fanfare provides the platform on an 'as is' basis. As a marketplace, we are not responsible for the products sold by sellers, including their quality, accuracy of description, or fitness for purpose.

To the fullest extent permitted by law, Fanfare's liability to you is limited to the amount you paid for the order in question.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

Your statutory rights as a consumer are not affected by these terms.

11. Marketing Communications

If you opt in to marketing communications during account registration, we may send you emails about new products, artists, and features on Fanfare. You can unsubscribe at any time by clicking the unsubscribe link in any marketing email or by contacting us at hello@wearefanfare.uk.

We will always send you transactional emails relating to your orders regardless of your marketing preferences.

12. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email with at least 14 days' notice. Continued use of the platform after that notice period constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
